Terms of Use

Welcome to DibsHub. These terms are a binding agreement between you and Essiel Express LLC(“DibsHub,” “we,” “us,” or “our”). By creating an account, visiting a barber’s page, requesting a booking, leaving a review, or otherwise using the platform, you agree to every section below, including the disclaimers, the limitation of liability, and the arbitration and class action waiver. If you do not agree, do not use DibsHub.

We have tried to keep the language plain. Where it needs to be firm, it is firm, because it protects both you and the platform. If anything is unclear, reach out at support@dibshub.com and we will explain.

1. Who can use DibsHub

You must be at least 18 years old, or the age of majority where you live, and able to enter a binding contract. If you use DibsHub for a business (for example as a barber or shop), you promise you are authorized to bind that business, and “you” includes that business. You may not use DibsHub if we have previously banned you or if the law prohibits you from doing so.

2. What DibsHub is (and is not)

DibsHub is a technology platform that helps clients discover barbers and shops, request appointments, and leave reviews, and helps barbers manage their bookings and clients. We are a venue and a tool. We are not a barber, a shop, or a provider of grooming or beauty services, and we are not a party to any agreement between a client and a barber.

The barber or shop is solely responsible for the services they provide, their pricing, their licensing and insurance, their conduct, and their compliance with the law. We do not employ barbers, we do not supervise appointments, and we do not guarantee the quality, safety, legality, or outcome of any service, any barber, or any client. Any dispute about a service, a payment, a no-show, or conduct at an appointment is between the client and the barber. You use DibsHub, and you attend or provide any appointment, at your own risk.

3. Accounts

You are responsible for everything that happens under your account and for keeping your password private. Give us accurate details, keep them current, and verify your email and phone when we ask, so we can keep the platform trustworthy for barbers and clients alike. Tell us right away if you suspect someone else is using your account. We may suspend or close any account, at any time, for any reason or none, including if we believe it protects the platform or its users.

4. Bookings

When you request an appointment, the barber reviews and confirms it. A request is not a guaranteed booking until the barber accepts it, and even a confirmed booking may be changed or cancelled by the barber. DibsHub does not guarantee that any barber will accept, honor, or complete a booking. Please show up, or cancel early enough that someone else can take the slot. Cancellation, deposit, refund, and no-show rules are set by the barber or shop, not by DibsHub, and are between you and them.

5. Payments and fees

Where payments are processed through DibsHub, they are handled by third-party payment providers (for example Stripe) under their own terms. You authorize those providers to charge your payment method for the amounts shown. Subscription fees for barbers and shops, where they apply, are described at sign-up and are billed in advance. Except where the law requires otherwise, fees are non-refundable. We may change our fees on reasonable notice. You are responsible for any taxes on the services you buy or sell.

6. Website hosting and care plans

Some businesses buy a website from us: we build it, host it, and keep it running. That work is billed as one-off invoices for the build, a recurring plan for hosting and care, or both, at prices agreed with you in writing before anything is charged. Plans renew automatically at the agreed interval until they are canceled, and we email you before each renewal so a charge is never a surprise.

To cancel a website hosting or care plan, email support@dibshub.com. We will confirm by email. Unless we agree otherwise, cancellation takes effect at the end of the billing period you have already paid for, so you keep the service through that period and are not charged again. There is no cancellation fee and you do not need to give a reason.

Amounts already charged are non-refundable except where the law requires otherwise or we agree in writing. If we do issue a refund, it goes back to your original payment method and your bank usually takes five to ten days to show it.

If an invoice is still unpaid seven days after its due date, we may take the site offline until the balance is settled. We will email you before that happens and while it lasts. The site comes back automatically as soon as payment lands, with nothing lost. After a plan ends we may stop hosting the site and remove it after a reasonable period, so please ask us for a copy of your content before you cancel if you want to keep it.

7. Reviews and your account data

To keep reviews honest, only clients with a verified email and phone can leave one, and you may leave a single review per barber (you can edit or remove it at any time). Your phone number is what stops one person from creating several accounts to stack reviews.

If you delete your account, we keep only your email address and phone number. Everything else, including your name, password, and login, is erased. We retain those two details for two reasons: so the reviews you already left stay attached and readable for the barbers who earned them, and so one person still cannot stack multiple reviews. You can reopen your account at any time by signing up again with that same email and phone: it restores the same account, with your past reviews, rather than creating a second one (you will confirm your email and phone again first). A barber may keep their own record of a client they have served (name and contact you gave them when booking). That record belongs to the barber and is separate from your DibsHub account.

8. Your content

You keep ownership of the reviews, photos, text, and other content you post. By posting it, you give DibsHub a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, display, reproduce, adapt, and distribute that content in order to operate, promote, and improve the platform. You promise you have the right to post what you post, that it is truthful, and that it does not infringe anyone’s rights or break the law. We may keep and use content you removed to the extent we already shared it or need it for legal, safety, or backup reasons.

9. Fair use and prohibited conduct

You agree not to:

  • post reviews that are false, misleading, abusive, or not based on a real visit;
  • impersonate anyone, or misrepresent who you are or your connection to a barber or shop;
  • spam, harass, threaten, defame, or discriminate against anyone;
  • scrape, crawl, harvest data, or use bots without our written permission;
  • probe, disrupt, overload, or try to gain unauthorized access to the platform or its data;
  • upload malware, or content that is illegal, obscene, or infringing;
  • use DibsHub to compete with us or to build a competing product; or
  • break any applicable law or regulation.

We may remove content, limit features, or suspend or close accounts that break these terms, and we may do so without notice.

10. Third-party services and links

DibsHub relies on and links to third-party services (for example payment processors, mapping, email and SMS delivery, and analytics). We do not control them and are not responsible for their acts, omissions, content, or policies. Your use of a third-party service is governed by that third party’s terms, not ours.

11. Our intellectual property

The DibsHub name, logo, software, design, and content we create belong to Essiel Express LLC and are protected by law. We grant you a limited, personal, non-transferable, revocable license to use the platform as intended. You get no other rights, and you may not copy, modify, resell, or reverse engineer the platform except as the law allows despite this limit.

12. Disclaimer of warranties

DibsHub is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. To the fullest extent the law allows, we disclaim all warranties, including merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage. We do not warrant that the platform will be uninterrupted, secure, error-free, or that any barber, client, booking, review, or piece of information is accurate, reliable, safe, or suitable. Some places do not allow certain warranty exclusions, so parts of this section may not apply to you.

13. Limitation of liability

To the fullest extent permitted by law, Essiel Express LLC and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or relating to your use of DibsHub, any booking, any service, any barber or client, or these terms, even if we were advised such damages were possible. This applies whether a claim is based on contract, tort (including negligence), warranty, statute, or any other theory.

Our total liability for all claims relating to DibsHub is limited to the greater of the amount you paid us in the three months before the event giving rise to the claim, or one hundred U.S. dollars (US $100). Some places do not allow some of these limits, so parts of this section may not apply to you; in that case our liability is limited to the smallest amount the law allows.

14. Indemnification

You agree to defend, indemnify, and hold harmless Essiel Express LLCand its owners, officers, employees, and agents from any claim, demand, loss, liability, damage, or cost (including reasonable legal fees) arising out of or relating to your use of DibsHub, your content, your bookings or services, your violation of these terms, or your violation of any law or any third party’s rights. We may take over the defense of any such claim, and you agree to cooperate with us.

15. Assumption of risk

Appointments happen in person and involve grooming services, tools, and products that carry inherent risks. You accept those risks. DibsHub is not responsible for injury, allergic reaction, dissatisfaction, damage, theft, illness, or any other harm arising from an appointment or from your interactions with any barber, shop, or client. Please use your own judgment about who you meet and what services you accept or provide.

16. Disputes, arbitration, and class action waiver

Please read this section carefully. It affects how disputes with DibsHub are resolved and limits your rights.

These terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-laws rules. First, we both agree to try to resolve any dispute informally by contacting each other at support@dibshub.com and giving 30 days to work it out.

If that fails, you and DibsHub agree that any dispute relating to DibsHub or these terms will be resolved by final and binding individual arbitration, and not in court, except that either party may bring an individual claim in small claims court, and either party may seek injunctive relief for misuse of intellectual property or the platform. You and DibsHub each waive the right to a jury trial and the right to participate in a class action or class-wide arbitration. Disputes will be handled only on an individual basis. If any part of this arbitration agreement is found unenforceable, the rest still applies, and any dispute that must go to court will go to the state and federal courts located in Florida, to whose jurisdiction you consent. Any claim must be brought within one year of when it arose, or it is permanently barred, unless the law forbids shortening the period.

17. Termination

You may stop using DibsHub at any time, and you may delete your account as described above. We may suspend or end your access at any time, with or without notice, including if you break these terms or if we stop offering the service. Sections that by their nature should survive (including content license, disclaimers, limitation of liability, indemnification, and dispute resolution) survive termination.

18. Copyright complaints

If you believe content on DibsHub infringes your copyright, email support@dibshub.com with a description of the work, a link to the content, your contact details, and a statement that you have a good-faith belief the use is unauthorized. We may remove infringing content and terminate repeat infringers.

19. Changes

We may update these terms as DibsHub grows. When we make a meaningful change, we will update the date above and, where it matters, let you know. Your continued use after a change means you accept the updated terms.

20. General

These terms, together with our Privacy Policy, are the entire agreement between you and DibsHub about the platform. If any part is found unenforceable, the rest stays in effect. Our not enforcing a right is not a waiver of it. You may not assign these terms; we may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets. Nothing here creates a partnership, agency, or employment relationship between you and DibsHub.

21. Text messages (SMS)

Appointment texts are optional. Your phone number is required to identify you and hold your booking, but we text you only if you opt in: by ticking the consent box on the booking form, or by joining a waitlist (where the text about an open spot is the service you are asking for). When you opt in, the business you booked with sends transactional messages through DibsHub: confirmations, reminders, reschedule and cancellation notices, waitlist openings, and pickup-ready notices. (One-time verification codes are sent only when you request them and are separate from this opt-in.) Consent to texts is never a condition of booking; decline it and you still book, and the business reaches you by email instead. Message frequency varies with your booking activity. Message and data rates may apply. You can reply STOP to any message to opt out, or HELP for help. Carriers are not liable for delayed or undelivered messages. How we handle the phone number and consent you give for texts is described in our Privacy Policy, including that mobile opt-in information is never shared with third parties for marketing.
